By accessing or using the Site, you accept and agree to be bound by these Terms. If you do not agree, do not use the Site.

Altura Financial Group is a life insurance business operating in New Mexico and Texas. References on this Site to products, services, quotes, or assistance do not mean that any product or service is available in every jurisdiction, to every person, or in every situation.

5. Licensing and Service Areas

Altura Financial Group operates in New Mexico and Texas at this time. Product availability, features, riders, benefits, underwriting classes, rates, and approval standards vary by carrier and by state. Not all products are available in all states.

6. No Guarantee of Coverage, Rates, Eligibility, or Results

We do not guarantee:

  • approval for insurance coverage;

  • issuance of any policy;

  • any specific premium, rate, underwriting class, or policy feature;

  • that any product is the lowest cost or best fit for your needs;

  • that any quote, estimate, illustration, or example shown on the Site will match final carrier terms;

  • any financial, tax, or personal outcome from obtaining or not obtaining insurance coverage.

All insurance decisions are made by the issuing carrier, based on the carrier’s underwriting rules and the applicant’s personal information, health, disclosures, and other relevant factors.

7. Quotes, Illustrations, and Examples

Any quote, illustration, premium example, sample scenario, or benefit amount shown on the Site is for informational purposes only unless expressly stated otherwise in a written carrier-generated document. Final policy terms are determined solely by the issuing carrier.

8. User Submissions and Lead Requests

If you submit contact information, request a quote, complete a form, upload documents, schedule a consultation, or otherwise provide information through the Site, you represent and warrant that:

  • all information you submit is true, accurate, current, and complete;

  • you have the legal right to provide that information;

11. Privacy

Your use of the Site is also subject to our Privacy Policy, which should be read together with these Terms. If there is a conflict between these Terms and the Privacy Policy regarding privacy matters, the Privacy Policy will control as to those privacy-specific issues.

15. Compliance With Carrier and Regulatory Rules

Information on the Site may summarize products or concepts, but official policy forms, carrier materials, disclosures, and state-required notices control. In the event of any conflict, the applicable policy documents and carrier materials govern.

16. No Warranties

17. Limitation of Liability

  • YOUR USE OF OR INABILITY TO USE THE SITE;

  • RELIANCE ON ANY CONTENT OR INFORMATION ON THE SITE;

  • ERRORS, OMISSIONS, INTERRUPTIONS, DEFECTS, OR DELAYS;

  • ANY PRODUCT, CARRIER DECISION, UNDERWRITING RESULT, OR POLICY OUTCOME.

TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

18. Indemnification

You agree to defend, indemnify, and hold harmless Altura Financial Group and its owners, officers, managers, employees, contractors, affiliates, agents, successors, and representatives from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and attorneys’ fees arising out of or related to:

  • your use of the Site;

  • your violation of these Terms;

  • your violation of any law or the rights of a third party;

  • your submissions, data, or communications.

19. Termination or Suspension

We reserve the right, in our sole discretion and without notice, to suspend, restrict, or terminate your access to the Site or any portion of it at any time for any reason, including suspected fraud, misuse, unlawful conduct, or violation of these Terms.

20. Changes to the Site or Terms

We may modify, update, suspend, discontinue, or remove any part of the Site at any time without notice. We may also revise these Terms at any time. Updated Terms become effective when posted on the Site with the revised effective date. Your continued use of the Site after updates are posted constitutes your acceptance of the revised Terms.

21. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-laws principles.

22. Venue and Jurisdiction

Any dispute arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in New Mexico, and you consent to the personal jurisdiction and venue of those courts.

23. Arbitration and Class Action Waiver (Optional but Strong)

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding individual arbitration, and not in court, except that either party may bring a qualifying claim in small claims court.

You and Altura Financial Group agree that:

  • claims will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding;

  • the arbitrator may not consolidate more than one person’s claims;

  • the arbitrator may not preside over any class or representative proceeding.

If you do not want arbitration in your website terms, remove this section before publishing.

24. Severability

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full force and effect.

25. Waiver

No waiver by Altura Financial Group of any provision or breach of these Terms shall be deemed a waiver of any other provision or any subsequent breach.

26. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or disclosures posted on the Site, constitute the entire agreement between you and Altura Financial Group regarding the Site and supersede any prior or contemporaneous understandings relating to the Site.
